Some authors are blase about their books being on pirate sites as they treat it as if it's an Amazon freebie and the people that visit pirate sites wouldn't buy their book anyway, but for someone to put their name against someone else's works is totally wrong.

I do vaguely recall this happening to someone some time ago, but can't remember if it was a member or just a "friend of a friend".

In my case, my name was still on the cover, so I wasn't too bothered, but I do remember someone else, who had written a book set in Southeast Asia where the writer's name had been changed. That's a lot more serious.

The site is offering it for free in various electronic versions. According to the nice man at Wiley it goes back to China *(surprise) but via an ISP in the US, which is the organization I should send the Cease and Desist Notice to. The nice man at Wiley gave me some info which is hard to interpret (need technohero hubby when he's not busy). Then I shall email them.

I'm kind of reluctant to email them in case if infection.

It's not the same as giving away copied via Amazon because it does nothing for my Amazon ranking.

I have drafted this based on a model form, what do you think?

As the sole owner of copyright, I hold the worldwide exclusive right to reproduce, modify, post, and distribute those materials and to grant others permission to exercise one or more of those rights. I have not authorized [insert name of entity receiving the letter] to reproduce, modify or distribute any of my materials in whole or in part.

Accordingly, [name of company] has no lawful right to copy, distribute, advertise, offer for sale and/or sell any material that copies, in whole or in part, or is based on my novel Death in Spigg’s Wood. I demand that you immediately:

1. Remove Death in Spigg’s Wood from your list of available downloads.

2. Destroy copies of Death in Spigg’s Wood including any computer stored versions and any other medium.

3. Notify all persons who have downloaded a copy issued by you that you have caused them to act unlawfully by breaching my copyright and that they possess illegal copies which they should destroy.

4. Notify me how many copies of my novel Death in Spigg’s Wood you have sold and the price at which it was sold.

5. Provide written assurances to me that you have complied with these directives and will not in the future sell or offer for free any of my copyrighted materials.

A week or so ago I noticed on my dashboard on iauthor that my book had received 6 visits from China. You can imagine what I thought. You just know they're yet more pirates and somewhere on the web Hide in Time will be showing up on yet more pirate sites. If so, I hope they get the message of the book, it's quite appropriate for pirates.

I'd suggest, Linda, that you take your time in tackling them to be sure you get it as right as you can. Not much help, I know, but one of my favourite sayings is all that it takes for evil to flourish is for good (wo)men to do nothing.

I think we tackle the ISP rather than the pirates themselves, which is useful. I've changed the draft to include the paragraph in that link and will email it tomorrow.

Well! I sent my Cease and Desist Notice to the ISP that the nice man from Wiley sent me when he looked up the site, and just got back from holiday to find the so and sos have done the same to Wargeld. Spigg's Wood appears to have been taken down, though, but I told them in my C&D notification to refrain from allowing any of my work to be downloaded and they have ignored that.

I have contacted Amazon.

At this rate I'll stick to Womag. Pays more and doesn't get nicked so readily. Sad
