What I Read

Advice required

I don't know if anyone has encountered this problem and could offer any adivice
I wrote a book called Buddha's Tooth years ago. I had to change the title due to putting it on a free ebook site, when I was naive, making it public domain.
I discovered this book is now being sold through itunes under a different authors name. The idiot is still using the same cover, which has my name on it.
Anyone any ideas or come across this before. Apple don't seem interested. My emails to them have gone unanswered. Thanks

Have you tried writing to the author? If you can't find his or her contact details, a negative review might get his or her attention.

I've never heard of this happening before - shocking

If you really made it public domain, I think you may be stuffed - that gives anyone the right to do whatever they like with it, including selling it under their own name.

Yeah....These free ebook sights don't warn you about this, and some authors recommend "Put your book on free ebook sights to get your name out there"

Yeah, I tried that Rosen. When I click on learn more about the author. A page comes up with 1 book....My book, and nothing else

Ahh...So this may not be public domain ( I was told by amazon that it was public domain. Is there any way to check?)....The site was free-ebooks.net....In that case is this legal?

Nope. For it to be public domain, you have to explicitly make it such with a statement like "This book is in the public domain" (or have your copyright expired, but unless you've been dead for 75 years, that's unlikely). Even then, you still have moral rights over the book (the right to be identified as the author), which cannot be removed.

I would suggest you issue a formal Take Down notice to Apple, stating that the book is your copyright an not licensed to this other author. You may have to provide evidence.

Apple's takedown submission is here: http://www.apple.com...

Remember: It is not public domain unless you explicitly make it public domain.

You've been a great help. I emailed apple through their site. I checked on their tracking  and it already had case closed.( did nothing) However, that was from their normal site. I went to Lulu, who not only published this man, but I also use them.They sent me a DMCA form and said they would immediately remove from site....So all being well it is all sorted.. I will try the site you kindly sent. That way it should be certain....I am amazed they did this to my book. Its not as if I am JK Rowling. I suppose I should be flattered, the buggers selling it for $48

I can't really help you, Robert, except to say this is bloody awful and good luck to you in however you want to combat this - I would follow Tim's good advice and not give up.

I do often wonder about those '1,000 ebooks on a DVD for a tenner' ads you see on ebay - and I know someone who has a Kindle full of top name titles that her daughter just 'put on' for her.

I hope it never gets to Napster proportions but this sort of thing is the downside of the ease of epublishing.
